
Scooters will have stricter trading rules from 2026 onwards. They are two- or three-wheeled vehicles with a maximum speed of 50 km/h, powered by up to 50 cylinder engines or electric motors with a capacity of up to 4 kilowatts. Among the changes are the requirements for the National Driving License (CNH) and vehicle licensing. Electric bicycles and self-propelled equipment will also have new standards.

The rules are set in 2023 by the National Traffic Council (CONTRAN). It also stipulates that these vehicles must be registered and licensed, carry a license plate, and can only be driven by those with an ACC (Authorization to Drive Motorcycles) or Class A driving licence. The use of a helmet and protective clothing is also mandatory.
Electric bicycles and self-propelled equipment will also have new rules. The decision maintains the exemption from registration and license plates, but sets technical standards, mandatory equipment and trading rules. Each municipality or state will continue to be allowed to create supplementary rules, such as allowing movement on specific roads or the possibility of collecting IPVA, when provided for by local legislation.

- Scooters manufactured or imported before the decision must be listed on Renavam between 11/1/2023 and 12/31/2025 – after which their circulation is prohibited.

Trading rules from 2026
Bicycles – It is forbidden to drive on highways and highways unless there is a shoulder or a designated lane. States and municipalities can set permitted roads and speed limits.
electric bikes – They can travel on bike paths, bike lanes, and bike paths, respecting limits set by the city or state council. Sports versions can have speeds of up to 45 km/h, only on roads, motorways or licensed competitions.
Self-propelled equipment – They may be allowed to travel on pedestrian zones at a maximum speed of 6 km/h or cycle paths, cycle lanes and roads at a maximum speed of 40 km/h.
Violations and expected penalties
The decision refers to violations already stipulated in Brazilian traffic law. among them:
- Driving in an unauthorized place – a moderate violation
- Driving on sidewalks or bicycle paths without a permit – a very serious offense
- Driving a motorcycle without a license plate or driver’s license is a very serious crime
- Driving a motorcycle without a helmet is a very serious offense with a suspended license
- Scooters or electric bicycles on highways/highways without a proper lane – a very serious offense
Vehicles excluded from the rules:
- Vehicles for exclusive off-road use
- Competition vehicles
- Equipment intended for the transportation of persons with disabilities or mobility impairments
