On October 31, the Public Ministry of São Paulo, represented by Public Prosecutor Marguerite Ferraz France, realized that all facts related to Thiago Castillo were clearly covered by the María da Penha Law.
The Foundation confirmed that two recorders were found hidden in Val’s room, and a tracking device was identified in her car, hidden in the first aid kit. The equipment will be linked to her ex-husband’s cell phone number.
In the latest demonstration, the Public Prosecutor requested that the case be referred to the Domestic Violence Court to continue the investigation under the lens of the Maria da Penha Law. On the third day, the case judge accepted the Public Prosecutor’s statements and referred the case to court.
Preventive measure
After more than a year of legal battle, Val Marchiori won the final protective action against her ex-husband. The socialite denounced businessman Thiago Castillo on charges of domestic violence, persecution and threats, and the judge maintained the protection stipulated in the Maria da Penha Law.
According to the decision, to which Fabia Oliveira’s column had exclusive access, the judiciary concluded that the risk scenario still exists and, therefore, the protection already granted cannot be revoked.
The decision notes that the “strong hostility between the parties” demonstrates the need to maintain the measures, even after defense statements demanding the dismissal of the case, which is being heard by the Central Court for Domestic and Family Violence against Women, in São Paulo.
Date of operation
The preventive measures were initially granted in March last year. Throughout the process there were requests for cancellation, but all of them were rejected, except for the removal of one of the restrictions stipulated in a previous decision. In July 2025, Thiago Castellio’s defense asked for annulment again, claiming that there were no new facts.
But Val Marchiore’s demonstration, represented by lawyers Rubens de Oliveira and Rodrigo Carneiro Maya, reinforced the existence of police investigations and records indicating a risk to his safety. The Public Prosecution also took a position in favor of maintaining protection, aware of the seriousness of the situation.
Judge’s decision
The judge stated in the ruling that the arguments presented by the defense did not exclude the reasons that justified granting emergency measures. The judge also stressed that even with the ongoing legal debate, the safety of the victim must prevail.
As a result, the protection remains in force for an indefinite period of time, as provided for in Article 19, paragraph 6, of the María da Penha Law. The decision makes clear that there will only be a review if the risk situation changes significantly.
