Soldier Kelvin Barros da Silva (featured photo), aged 21, who killed Maria de Lourdes Freire Matos, 25, from the same institution, saw his arrest in flagrante delicto transformed into preventive this Saturday (12/06) after undergoing a custody hearing at the Custody Hearing Center (NAC).
The judge understood that there are concrete elements to justify the preventive detention of Barros. “The regular situation of flagrance in which the accused was caught makes certain the materiality of the crime, also sufficiently indicating his paternity, both in the reports collected in this report and in the body collection guide,” declared the magistrate.

According to the judge, the offense committed is very serious and carries a prison sentence of more than four years, in accordance with section I of art. 313 of the Penal Code.
“The case is very serious and involves, among other crimes, femicide, a crime committed with extreme violence against the person and which devastates Brazilian society. Preventive detention is necessary to preserve public order. The public outcry makes it imperative the preventive detention of the person caught in the act to indicate to society zero tolerance for this fact,” the judge said in the decision.
Still according to the judge, the fact that the offense was committed in a military environment makes the case even more serious, “because it endangers the hierarchy and discipline necessary for the exercise of military activity and also gives rise to the decree of preventive detention to guarantee public order.”
The fact that the soldier made the investigation difficult by using fire to ignite the victim’s body was also taken into consideration by the magistrate.
The crime
Maria de Lourdes was a corporal in the army, having entered service five months ago as a musician. She was found dead by firefighters (CBMDF).

According to Barros, they were having an extramarital affair. “After an argument in which the woman asked him to break up with his current girlfriend and take her back, as promised by the perpetrator, the victim pulled out his firearm,” commented delegate Paulo Noritika.
“He allegedly held the pistol while she tried to load it. In the meantime, he managed to reach the victim’s military knife, which was on her waist, and hit her deeply in the neck,” detailed the delegate.
Noritika further said that the victim was found with a sharp weapon at the scene of the injury. “After that, in desperation, he grabbed a lighter and some alcohol, set fire to where the group was based and fled, taking the gun with him and getting rid of it,” he said. Firefighters were called to put out the flames.
