
Minc’s dissenting vote provoked a clash between him, rapporteur Rodrigo Amorim (União), CCJ vice-president Fred Pacheco (PMN) and Knoploch. They argued that the draft resolution should be published, because if that is the decision of the plenary, it should be expressed in the text. During the discussion, Amorim even stated that he had voted for the constitutionality of the “marijuana and nudist beach” projects, but took an opposite position in plenary. Knoploch accused Minc of being a “clown.” The Psbedist asked Knoploch to retract his statement, but he refused and they began to argue. The microphones were cut.
Minc (PSB) anticipated his opinion and declared himself in favor of maintaining Bacellar prison. He presented a vote against the rapporteur because he believed that the project should focus on continued detention and agreed with Luiz Paulo that abolition could be voted on separately.
— I agree with the decision of the Supreme Court and I do not agree with the draft resolution. We have this recognized duty, but this referral is contrary to the STF decision. Whatever my opinion on Bacellar, the data collected was very serious. A person with the power of president can influence the investigation, Minc said.
