
Three of the defendants in the trial of the third nucleus of the coup plot in the First Circuit of the Federal Supreme Court, which began last Tuesday (11), are black children who continue to be active, despite the exit of many of the defendants from the armed forces in recent months, as the case progresses in court. The trio should join the group of military personnel convicted of conspiring against Lula’s inauguration, including former President Jair Bolsonaro.

The blog team from the Army discovered that Lt. Colonels Helio Ferreira Lima, Rafael Martinez de Oliveira, and Rodrigo Bezerra de Azevedo are still active. The three are being held in army units – Ferreira Lima in Manaus, de Oliveira in Niteroi (RJ), and Bezerra de Azevedo in Brasilia. They also continue to receive a salary.
Their removal from the force will only be assessed after the conviction is confirmed. In cases where they are sentenced to more than two years’ imprisonment, the military statute provides for their expulsion, but they must first undergo trial in the Supreme Military Court (STM).

As we blogged in September, all military personnel identified by the Public Prosecutor’s Office (PGR) as members of the coup attempt decided to emigrate to the reserve, including many FE members.
By then, 16 officers had asked to leave the force. Since then, another defendant has formally submitted his request: Lieutenant Colonel Sergio Cavaliere, who is among the defendants in Group 3 but was not part of the Special Forces.

All of them, according to the PGR, were part of the secret surveillance of authorities such as Supreme Federal Court (STF) Minister Alexandre de Moraes, Lula and the then Vice President-elect, Geraldo Alckmin, along with General Mario Fernández – another black child awaiting trial in the second nucleus of the coup plot and who has already retired.
National Front investigations showed that the plan was articulated in a WhatsApp group called “World Cup 2022” where members identified themselves with the names of countries in the form of code names to carry out the Punhal Verde e Amarelo plan, which envisaged the kidnapping and murder of Moraes, Lula and Alckmin.
According to the PGR, De Oliveira, as his nom de guerre, and Ferreira Lima held leadership positions in the plot’s operational strategy.
Also according to Prosecutor Paulo Gonet, the duo led “field actions aimed at monitoring and neutralizing public authorities” and “contributed to the planning of a coup” that used military and terrorist techniques to eliminate Alexandre de Moraes and the winning ticket at the ballot boxes formed by Lula and Alkmén.

In addition to Ferreira Lima, de Oliveira and Azevedo, another soldier involved in the coup plot remains in the army, but for a short time. This is the case of Lieutenant Colonel Mauro Cid, who was sentenced in September to two years in prison.
Bolsonaro’s former aide, Cid, received the lesser sentence from the so-called crucial nucleus of the coup because he struck a plea deal with the Federal Police (PF) that served as the linchpin of the PGR indictment.

As we said in the blog, the applicant requests immigration to the reserve within the compulsory quota, when the number of vacancies for promotions does not reach the minimum stipulated by the force. However, the army commander, Thomas Paiva, should analyze the request only at the beginning of next year. The rest were transferred to the reserves because they had already served enough time.
During the trial, Mauro Cid’s defense stated that the soldier would not have “psychological conditions” that would enable him to continue military service. The assessment within the military leadership is that the other defendants followed the same scenario because they considered that there was no climate to remain on active duty.

Due to a prison sentence of only two years, Cid avoided responding to an operation at STM that could have exposed him to losing his rank and being declared unworthy of the military. But that is not the case with Bolsonaro and other convicted soldiers, such as Generals Walter Braga Neto, Augusto Heleno, and Paulo Sergio Nogueira, who were all sentenced to more than 20 years in prison.
In the case of the black children of Nucleus 3 and other military defendants in the coup plot, this diagnosis will depend on the Supreme Court rulings against the convicted officers. The duties of the military judiciary fall outside the jurisdiction of the Army Command.
