
Former first lady Michelle Bolsonaro (PL) used social networks this Thursday (11/12) to comment on the decree of Minister Alexandre de Moraes, of the Supreme Federal Court (STF), to annul the decision of the Chamber of Deputies and decree the immediate loss of the mandate of deputy Carla Zambelli (PL-SP).
“It’s… Congress. Unfortunately, it’s sad to see you so weakened and on your knees in the face of so much arbitrariness,” she wrote.

The House voted to lose Zambelli’s mandate in the early hours of Thursday. In total, 227 deputies voted for and 110 against, with 10 abstentions. For the MP to lose her mandate, 257 votes would be required and, therefore, the representation against the MP had been archived.
Moraes’ decision, however, reverses the situation.
In a decision, Moraes affirms that the deliberation of the Chamber of Deputies, which rejected the loss of Zambelli’s parliamentary mandate “occurred in flagrant violation of Article 55, III and VI, of the Federal Constitution.”
“This is a void act, due to obvious unconstitutionality, demonstrating both a lack of respect for the principles of legality, morality and impersonality, as well as a flagrant deviation from the desired goal,” considered the judge.
Carla Zambelli was sentenced by the first panel of the STF to 10 years in prison last May for having participated, with a hacker, in the invasion of the systems of the National Council of Justice (CNJ).
She is stuck in Italy after fleeing Brazil. As a prisoner, the parliamentarian cannot vote or exercise the mandate for which she was elected, but she has maintained it, until then, by decision of the House.
She has been imprisoned in Italy since July 29, after fleeing Brazil. Under these conditions, Zambelli cannot vote or exercise the mandate for which she was elected. Despite this, he has maintained his position until now by decision of the Chamber of Deputies.
