Allies of former President Jair Bolsonaro reacted by criticizing the decision of Minister Alexandre de Moraes, of the Federal Supreme Court, who ordered the dismissal of MP Carla Zambelli (PL-SP).
The minister’s act overturns the decision of the House, which voted to avoid the loss of the MP’s mandate. In turn, the decision of the deputies goes in the opposite direction to what the Supreme Court had determined.
Former first lady Michelle Bolsonaro was among those who criticized the STF on social media.
“It’s… the Congress. Unfortunately, it’s sad to see you so weakened and on your knees in the face of so much arbitrariness.”
The leader of the PL in the House, Sostenes Cavalcante (RJ), attacked the minister because of this decision.
“The psychopathic dictator who governs the three Powers today has attacked again. When a minister overturns the sovereign decision of the House and overturns the popular vote, it ceases to be Justice and becomes an absolute abuse of power. Brazil has seen an act of institutional usurpation: a man going beyond the heads of Parliament and the will of the people,” he said.
Moraes considered null the decision of the Chamber which maintained the mandate of Carla Zambelli and ordered on Thursday the inauguration of the parliamentary deputy, Adilson Barroso (PL-SP).
With this decision, Moraes decreed the immediate loss of the parliamentary mandate and ordered the Speaker of the Chamber, deputy Hugo Mota (Republicanos-PB), to take office as substitute within a maximum period of 48 hours, in accordance with article 241 of the Internal Regulations of the Chamber.
According to Moraes, the deliberation of the Chamber of Deputies, which rejected the loss of Zambelli’s mandate, “took place in flagrant violation” of the Constitution.
MP Nikolas Ferreira (PL-MG) was also critical.
“Look at the second paragraph. The Constitution is nothing but toilet paper for Moraes.”
Likewise, Senator Damares Alves (Republicanos-DF) expressed his dissatisfaction.
“INCREDIBLE! One decides that the Senate can no longer request the dismissal of the STF ministers, the other annuls the decision of the plenary of the Chamber of Deputies. I hope that all my parliamentary colleagues now understand what I mean when I denounce that we are living a dictatorship of the judiciary. Either we put things in their place immediately, or we can now decree the end of the National Congress.”
The minister also asked the chairman of the First Panel of the STF, Flávio Dino, to schedule a virtual session for this Friday, from 11:00 a.m. to 6:00 p.m., so that the other ministers of the collegiate can judge whether or not they confirm the decision he made. The Attorney General’s Office has been informed of the decision.
Deputy Colonel Tadeu (PL-SP) indicated that Moraes’ decision causes friction between the powers.
“We talk about “separation of powers”, but in practice, it has become a FRANCE! If the ONE is supposed to run everything, then Congress becomes a mere extra. Hand over the keys and turn off the lights!”
