The 1st Criminal Chamber of the Federal Court of Justice (TJDFT) confirmed the conviction of an official of the Federal Court of Auditors (TCU) who persecuted, insulted and disseminated false information about a family of neighbors in a condominium in the South-West (DF). The victims are an agent of the Civil Police of the DF (PCDF) and his daughter.
According to the complaint filed by the DF Public Prosecutor’s Office (MPDFT), the accused persecuted the victims between August 2021 and July 2022. There were several episodes of threats to the psychological integrity of the police officer and his daughter, in addition to the creation of a fraudulent file and offenses by telephone and SMS.
The defendant was sentenced to two years in prison and a 40-day fine. He appealed, denying the charges against him, but Judge Asiel Henrique de Sousa, of the 1st Criminal Court, rejected the appeal. The other magistrates followed the rapporteur, taking the decision unanimously.
“You cow”
Several charges weigh against the defendant. In August 2021, for example, he contacted the military police (PMDF) saying that his neighbor had threatened to demolish his car. A vehicle went to the South West condominium and found that the information was not accurate.
That same month, the defendant took advantage of his status as a TCU employee to access the agency’s information systems and obtain his neighbor’s personal data. He then sent a message to the victim telling her he had the information. He even used the data to create a false file reporting alleged fraud in the award of work in the condominium where they live.
Some time later, in February 2022, the perpetrator turned off the circuit breaker on the police officer’s electrical panel and his daughter’s apartment. The condominium’s security cameras caught him entering the room where the building’s circuit breakers are located, exactly when the power was cut to the victims’ house.
The same day, he called the police officer’s home. Her daughter responded and had to listen to the following insults: “You bitch. You can go to court, I will hurt you.
In another episode, the accused sent messages to the officer via WhatsApp, stating: “Marginal, son of a bitch of a cop. The police need to go fuck themselves.”
The officer and his daughter had to seek psychological help because of what happened. During his testimony, the man claimed that the persecution actually began in 2018. In some cases, the defendants allegedly threw eggs at the family car.
The manager of the condominium at the time witnessed the victims and said she had already been threatened in the same way.
