The District Court of Valencia has annulled the appeal of the special accusation requiring that the Aldana case investigated by the judge of Cataroga (Valencia), Nuria Ruiz Tobarra, be transferred to the Superior Court of Justice of the Valencian Community (Tsjcv) in order to investigate the Acting President of the State of Valencia, Carlos Mazzón. Prosecutors believe Mazzone should have asked the central government to declare a national emergency during the flood that left 229 people dead on October 29, 2024, according to TSJCV sources.
The six judges of the Valencia District Court thus confirm the decision taken by the Cattaruga judge last May. The coach refused to send a reasoned statement to the TSJCV against the state president on the grounds that he had no authority. He also refused to name the government delegate in Valencia, socialist Pilar Bernabe, as being under investigation.
After examining the allegations, the court found that the coach’s decision was “reasonable” and affirmed that the appeal should be “directly dismissed.”
According to the order, the appellants do not “properly” argue that “the requirements indicated by the order of the TSJCV” were met, which in December 2024 refused to open a case as a result of complaints and complaints against the Chairman of the Council for his actions during Dana. For the judges, the appeal at this stage does not include “sufficient justification for the approval of budgets under Article 11 LOPJ” (the Basic Law of the Judiciary).
In the same decision, the Second Division again rejects the request to indict the Government Delegate of the Valencian Community, because the appeal does not contain “new allegations” that would justify the adoption of a different decision than had previously been resolved on the same issue by the same court in previous decisions.
The court issued a second order, also notified this Wednesday, dismissing the appeal of another special charge, which in this case required the Cattaroga judge to call several witnesses, including the former Secretary of State for Security and Minister for Transport and Sustainable Mobility.
