The Consumer Protection and Defense Program (Procon) city of São Paulo fined Enel dealer in R$14.2 million due to breakdowns in electricity distribution in the city of São Paulo last week, especially between December 8 and 10.
“Up to 3 million consumers found themselves without electricity during this period,” said the agency in a press release published this Monday 15 by the São Paulo city hall. Enel will be informed and will have 20 days to present an administrative defense.
The company, in a statement, reiterated that the region was hit by winds that lasted about 12 hours and reached speeds of up to 98.1 km/h. He also indicated that since Wednesday, he had deployed 1,800 “teams” to the streets in a few days to carry out the necessary repairs and that the situation of those concerned had normalized last Sunday 14 (see below).
According to Procon Paulistano, the dealer had already been warned on other occasions due to defects already detectedbut the company allegedly failed to make the necessary adjustments to provide the service.
The fine, the program specifies, “is the result of the analysis of complaints registered by consumers and the technical investigation carried out by the consumer protection agency, which noted non-compliance with the standards established in the Consumer Protection Code”.
Among the problems highlighted by Procon Paulistano are service outages, supply interruptions and lack of adequate information provided to users.
“The concessionaire failed to ensure the continuity and efficiency of the essential service, in addition to not fully responding to the requests of the consumers concerned, which constitutes a violation of the legislation in force,” he asserts.
A gale hits the capital and the metropolitan region of São Paulo
Last Wednesday, thousands of people in the capital and the metropolitan region were hit by a power outage after a storm reaching nearly 100 km/h.
The phenomenon, originating from an extratropical cyclone that formed in the south of the country, caused the cancellation of flights and the fall of hundreds of trees in the city. According to firefighters, there have been more than 1,400 calls for this type of incident in Greater SP.
This is also why around 2.2 million properties were left without electricity and, for some, without water due to lack of energy for pumping.
The distributor also indicated that operations “returned to normal standards” for customers affected by the storm. “At this time, teams are working to address cases recorded in the days following the weather event.”
The latest update from Enel, this Monday, shows that 43,842 properties in the city of São Paulo are without electricity. By adding up the entire concession area where the distributor operates, the number of customers concerned rises to 65,334.
Last Friday, when the total number of affected customers was still around 700,000, the São Paulo court ordered Enel to restore service to all consumers within 12 hours, subject to payment of a fine of R$200,000 per hour of delay.
Procon from the State of SP also informs Enel
Last Thursday 11, Procon-SP, from the State Government, informed the dealership also due to failures in the provision of services to customers in the capital and the metropolitan region of São Paulo.
The agency gave a deadline of six days – which expires next Wednesday 17 – for the company to provide clarification on “the logistical structure and the contingency plan to deal with emergency situations”, such as those that occurred last week.
Among the motivations that prompted Procon to warn the company are consumer complaints that highlight delays in the distributor’s action to supply energy, as well as images of an Enel garage with parked company vehicles and reports that, at the time, there were no “teams in large quantities on the streets”.
The notification is not yet a fine because Enel is within the response time, but, according to Procon-SP, the distributor still provided the requested clarifications. The company was contacted by the Report for comment on the Procon State notification, but reneged until the text was released. The space remains open.
