According to the Federal Police, Judge Macário Júdice Neto, of the Regional Federal Court of the 2nd Region (TRF-2), met with dismissed state deputy Rodrigo Bacellar (União Brasil) on the eve of the operation that arrested Tiego Raimundo dos Santos Silva, known as TH Joias. The duo are under investigation for allegedly leaking information about the operation to TH, accused of drug trafficking, corruption, money laundering and arms trading on behalf of the Red Command. Still according to the PF, Bacellar was with Macário Júdice at the time when TH sent messages in which he talked about leaving his home to avoid the operation and destroying evidence. The magistrate’s defense denies the accusations.

Macário Júdice Neto is the rapporteur of the TH Jóias case at the Federal Regional Court of the 2nd Region (TRF-2). He was arrested this Tuesday morning by PF agents. The arrest took place as part of Operation Nail and Flesh 2, launched to investigate the role of public officials in leaking confidential information about police operations. In the first phase of the action, on the 3rd of this month, the former president of the Legislative Assembly of Rio (Alerj), the dismissed state deputy Rodrigo Bacellar (União Brasil), who was also the target of searches this Tuesday, was arrested.
The decision determining the arrest, signed by Minister Alexandre de Moraes, specifies that the dialogues analyzed on Rodrigo Bacellar’s phone indicate that he was with the judge on September 2, in a steakhouse in Aterro do Flamengo.

“Which allows us to conclude that Bacellar and Macário were probably together when TH Jóias sent messages to Bacellar regarding his escape and the destruction of evidence,” says an excerpt from the document.

According to the PF, after being informed of the operation, which took place on September 3, TH Jóias organized an operation to destroy the evidence he kept at his home. He even reportedly used a box truck for this. With the new phone, he sent a video to the president of Alerj asking if he could leave some items. One of them was a freezer.
The judge’s defense denied that the dinner took place and declared that “the information mentioned in the message used in the representation of the Federal Police does not correspond to the truth.”
“If the deputy declared that he was with Judge Macário Júdice, the statement is false, and the restaurant’s security cameras can prove it. If it were true, the Federal Police would have obtained these images. The defense transmits to the minister the ratification of the absolute refusal of the meeting. The messages between the deputy and the judge date from May and are not linked to any judicial process. The defense therefore reaffirms the denial of the facts and asks itself the questions: “who is interested? Is Moraes making a mistake?’. The defense believes in the serenity of the decisions of Minister Alexandre de Moraes and in the revocation of the arrest,” indicates the note, signed by lawyer Fernando Augusto Fernandes.
The dialogues reveal the close relationship between the judge and Bacellar
Conversations obtained during the Federal Police investigation show that the judge and Rodrigo Bacellar maintained close friendly relations. In several posts, the two called each other brothers and talked about their personal lives. There are also dialogues in which they ask for favors and discuss personal disagreements.

In one of the messages obtained by the police, the magistrate requests tickets for Flamengo’s match against Ceará, played in November this year, for the Brazilian Championship.
According to the intercepted messages, Bacellar responded that he would do his best to comply with the request. “Even if I break down the gate, I will find a way. I have common sense, my godfather,” he wrote, in a conversation followed by the PF.

Exchanges recorded on messaging apps also feature declarations of affection and loyalty, such as “you are a brother for life,” “I love you,” and “I will take you to the coffin, brother.” For researchers, the content of the dialogues testifies to a personal proximity and mutual trust between the judge and the politician.

Rodrigo Bacellar’s defense states that “the parliamentarian always made himself available to demonstrate his non-involvement in the reported facts, providing all the necessary details. Furthermore, when he was questioned, he informed police headquarters that he had just moved, providing his new address.
