The general director of Aneel calls for the urgency of guiding the processes involving Enel | Brazil

Feitosa also requested that the possibility of including the renewal process of the Enel Ceará contract be evaluated, which is also awaiting analysis by the regulatory agency.

The request was sent by memorandum signed on Monday (15). During his request, the director evokes the relevance of the processes of anticipation of the effects of the extension of concession contracts and of “the intensification of extreme weather phenomena throughout the territory, and their impacts on the continuity of public services”. The general manager also indicated that, if the directors deem it necessary, a new extraordinary meeting of the board of directors may be convened to analyze the issues.

The process of renewing the Enel São Paulo concession is suspended by court decision. The renewal processes of Enel Ceará and the case of the subpoena of Enel São Paulo are being reviewed by director Gentil Nogueira.

In response to the request, the director said both processes are not “suitable” for inclusion on the agenda because they require relevant information to help better understand and move cases forward.

According to the director, in the case of Enel São Paulo’s summons, the technical sector of the regulatory agency was asked to evaluate the actions and performance of the distributor in the face of the weather event that occurred on December 10 and 11, 2025, similar to that requested for the weather event of September 2025. The discussion of this process involves the dealer’s ability to react to previous weather events.

In the case of the expansion of Enel Ceará, the director requested an evaluation from the Federal Prosecutor’s Office to the regulatory agency on the procedure to be adopted regarding the results plan approved by the Ministry of Mines and Energy (MME). The plan was presented by the company as an alternative to allow the extension of the contract, as it did not meet the criteria established by the government and taken into account by Aneel in the concession evaluations to recommend or not the extension.

The director, however, stressed that, as soon as there are responses to his requests, he will accelerate the evaluation and may request an extraordinary meeting, if necessary.
