The Constitution and Justice Commission (CCJ) of the Senate rejected, this Wednesday morning (17), two requests which could postpone the vote on the bill which could reduce the sentences of those convicted on January 8, said “PL dosimetry“. The collegiate vote should take place today.
Government senators presented three requests that could have postponed the deliberations of the PL dosimetry by the CCJ and, consequently, by the plenary of the Senate. They argued that the House had little time to discuss the proposal, which was approved by the Chamber of Deputies in the early hours of last Wednesday (10).
The senator Fabiano Contarato (PT-ES), requested a public hearing to discuss the subject, which was rejected by 15 votes to 9. In the same spirit, senator Rogerio Carvalho (PT-SE), presented two requests to postpone the discussion and vote on the proposal. The latter two were rejected by 15 votes to 11 and 15 votes to 10 respectively.
With the rejection of the postponement of the vote, the rapporteur, Amin Esperidioão (PP-SC), you will now read your review. As shown in Valuethe senator limited the regime’s faster progression to crimes linked to the democratic rule of law, ffill a gap that allowed other crimes committed with violence or serious threat to benefit from this benefit.
If Amin’s opinion is rejected, the CCJ will consider two separate votes from senators Alexandre Vieira (MDB-SE) and Randolf Rodrigues (PT-AP) who propose the total rejection of the question.
If the subject is rejected by the majority of collegiate senators, it will be archived and will not even be discussed in plenary session of the Senate.
In addition to the faster advancement of sentences for those convicted on January 8, the article proposes that the punishment for the crime of attempting to abolish the democratic rule of law be absorbed by the crime of coup d’état, considered the most serious. Thus, we see a reduction in the number of those who were classified into these two criminal types, whose sentences were added together in the calculation of the final sentence of these convictions.
The proposal also provides for a reduction of the sentence between one third and two thirds in the event that the convicts committed the crimes of attempted abolition and coup d’état “in a crowd context”, which would benefit the people who invaded the headquarters of the Three Powers that day. January 8, 2023. The text specifies that, for this, the agent cannot have “carried out an act of financing nor exercised a leadership role”.
Even with the rejection of the postponement of the vote, the scenario of approval of the PL dosimetry is not yet pacified. The headquarters of the PT and the MDB, as well as the senators of the PSD, have already spoken out against the text.
