Procedural risks and adversarial system
Prosecutors claimed that the maneuver showed clear signs of planning and the use of a legitimate business activity as a pretext. When requesting Preventive detentionthe prosecutors argued:
-
Risk of escape: due to the seriousness of the crime and the high punishment expected.
-
Lack of roots: The addresses and family ties provided by the defendant in Misiones could not be confirmed.
-
Obstruction: Evidence is pending which could be compromised if the defendant regains his freedom.
Judge Fresneda confirmed the prosecution’s arguments and set a deadline of 65 consecutive days for the preparatory criminal investigations, a prison sentence which the defendant must serve by February 11, 2026.
This case sets a legal precedent adversarial and adversarial systemin which the management of the investigation lies exclusively with the public prosecutor’s office, which increases response times for complex crimes such as: Drug trafficking.
