
In a defeat for the President of the Senate, Davi Alcolumbre (União-AP), the senators rejected, this Wednesday (17), by 36 votes to 28, the urgent request to include in the bill that regulates the operation of casinos, bingos, Jogo do Bicho and betting in Brazil. The deliberation will now extend until 2026.
The proposal divides grassroots and opposition parliamentarians and has already seen its deliberation in the Senate more than three times in the past three years.
Alcolumbre, favorable to the subject, tried to move the text forward, by going to discuss with his peers and ceding the presidency to his vice-president, Eduardo Gomes (PL).
Before voting on the emergency, Gomes announced that, if included on the agenda, the project would be voted on symbolically. However, when voting on this request, rapporteur Irajá Abreu (PL-TO) and other senators requested a roll call vote. Defeated, Alcolumbre leaves the Senate.
To protest against this maneuver, the PL, the Republicans and the Novo entered into obstruction, reducing the quorum. However, after checking the possibility of preventing discussion of the subject, the parties voted no to this request.
Alcolumbre and Gomes’ idea of carrying out a symbolic vote on the merits aimed to take advantage of the time, unusual for votes in the Senate, because parliamentarians opposed to the text would have to wait an hour to request a roll call vote.
The regulations set a minimum interval of one hour for a request for a roll call vote if another symbolic vote has already taken place during this session, which took place this Wednesday.
The proposal creates a broad regulatory framework for the gaming and betting sector, providing for licensing rules, monitoring, taxation and money laundering prevention mechanisms.
The project authorizes the operation of casinos exclusively in integrated leisure complexes, which must meet certain requirements, such as a minimum number of around 100 rooms and facilities for large cultural events. The gaming area will be limited to 20% of the total and interested companies will have to demonstrate a minimum capital of R$100 million.
The text authorizes one casino per state up to 15 million inhabitants, two for those between 15 and 25 million and three when the population exceeds this number. Amazonas and Pará, although they do not meet the population criteria, can have two casinos due to their large territorial extension.
In the case of bingo, the rule provides for one establishment per 150,000 inhabitants and for Jogo do Bicho, one per 700,000 people, requiring a minimum capital of 10 million reais.
The text also specifies that the competence is exclusive to the Union, exercised by the then Ministry of Finance, to formulate sector policy, standardize, supervise, inspect and apply sanctions in the operation of games and betting.
The text establishes taxes specific to the sector. It is planned to create a Contribution for Intervention in the Economic Domain (Cide-Jeux) of 17% on gross revenues from the operation of games.
In addition, the terms will also pay, on a quarterly basis, a gaming and betting inspection (Tafija) fee. For casinos, R$600,000 will be charged per establishment, for bingos and Jogo do Bicho, the fees will be R$20,000 per establishment and entity respectively.
