
The National Electric Energy Agency (Aneel) decided this Thursday (18) to increase the number of employees who will supervise Enel São Paulo. Responsible for the distribution of electricity in 24 municipalities in the metropolitan region of São Paulo, including the capital, the concessionaire has faced successive problems in providing the service. This week, the Minister of Mines and Energy, Alexandre Silveira, began a process that could result in the expiration of the company’s concession.

In addition to expanding the inspection team, Aneel announced, during a meeting held this morning, the creation of an internal committee to coordinate actions already underway against the dealership.
— Today we approved an order temporarily designating employees from other sectors for inspection, to ensure that any actions the company says it will take can be properly verified — said Aneel CEO Sandoval Feitosa.
The investigation into the event that occurred on December 10, when an extreme weather episode once again compromised the energy distribution system, will be carried out by Aneel in collaboration with the Public Services Regulatory Agency of the State of São Paulo (Arsesp).
The aim is to check whether there has been a recurrence of failures in restoring service, one of the main problems highlighted in previous inspections.
Since 2023, Enel has had episodes of power cuts in São Paulo. This story resulted in the application of the largest fine ever imposed by Aneel on a company in the electricity sector, amounting to 165 million reais. However, the proceedings are suspended by court decision.
In relation to the outage recorded in 2024, Aneel published a notice, which constitutes a preparatory step for a possible recommendation for the expiration of Enel’s concession contract. If this recommendation progresses, the process will be transmitted to the Ministry of Mines and Energy, responsible for the final decision.
In a letter sent Wednesday to Aneel, Minister Alexandre Silveira reiterated that the agency must adopt measures regarding the Enel concession in the face of successive failures in the provision of the service. In the document, the minister listed a series of communications transmitted by the MME to Aneel since 2023.
“I reiterate the determination already manifested in the other documents mentioned above to immediately open an administrative procedure to analyze the failures and transgressions of this distribution concessionaire, with the aim of identifying a possible breach of contract or recommending the expiration of the Enel São Paulo concession, in the state of São Paulo,” he wrote.
In a statement, Aneel said that it acts in strict compliance with legal procedures and the public interest, with the aim of ensuring the adequate provision of energy distribution service to consumers in São Paulo.
