The decision of the Minister of the Supreme Federal Court (STF) André Mendonça who authorized another phase of the Operation without discounts, as part of the investigation into INSS fraud, last Thursday (18), brings a mystery that even members of the Federal Police (PF) have not been able to decipher until now.

In a dialogue between Antonio Carlos Camilo Antunes, known as Careca of the INSS, and the businesswoman Roberta Luchsinger, designated by the PF as her associate in matters related to public health, she expresses her fear of the seizure of an envelope bearing the name of a “friend” of both.
Roberta is very close to Fábio Luís Lula da Silva, son of President Lula known as Lulinha, and his wife, Renata Abreu Moreira, whom she describes as “her soul mate”.

Lulinha was not the target of today’s operation and is not the subject of any investigation by the PF. His possible involvement in the INSS scandal was revealed after a former INSS employee Careca said in a statement to the PF that he had received an allowance of R$300,000.
The conversation recovered by investigators took place on April 29 of this year, six days after the mega-operation that disrupted the project and led to the fall of the former president of the institute, Alessandro Stefanutto, currently in prison.

At the time, Careca was one of the targets of 52 search and seizure warrants executed by the PF. Roberta, heir to Swiss banker Peter Paul Arnold Luchsinger, who died in July this year, searched for the origins of the scandal via WhatsApp and suggested she consult a lawyer.

One of the PF’s objectives with today’s action is to identify the alleged envelope, discover which friend Roberta is referring to and understand how she became aware of the material seized during the first phase of Operation No Surrender. The businesswoman was not among the targets at that time.

According to the PF, almost a week after this conversation, on May 5, Lulinha’s business friend sent Careca a new message from the INSS, this time in audio form, in which she apparently sought to reassure him.

In this excerpt, Roberta directly refers to the rumors that spread on the Internet at the beginning of Operation Lava-Jato, according to which Fábio Luís Lula da Silva was a hidden partner of Friboi, a brand of JBS – the company of the Batista brothers which grew exponentially under the PT governments under the policy of the national champions of the BNDES and became the target of the operation at that time.
For the investigators questioned with reservation, another dialogue captured by the PF and highlighted in Mendonça’s decision seems to refer to the son of President Lula.

During a press conference at the Palácio do Planalto this Thursday, the PT member declared that, if Lulinha is involved in the case, “she will be investigated.”

According to the Federal Police, the businesswoman’s company had a contract with one of the INSS Careca companies also studied in the investigation, Brasília Consultoria Empresarial. In the document obtained by the company, which bears Roberta’s signature, there was a provision for the payment of R$100,000 for each of the three projects listed – “Energia Project”, “Esmagadoras Project” and “Hidrogênio Project”.
Mendonça’s decision highlights that the aforementioned initiatives “completely escape” the scope of activity of Brasília Consultoria Empresarial.

To justify the transfers, according to the PF, the duo issued invoices for consultancy services for “apparently non-existent” services provided by the businesswoman.
Roberta is described in Mendonça’s decision as an “essential” character in the project led by Careca of the INSS in the “concealment of assets, movement of values and management of bank accounts and corporate structures used as instruments of money laundering.”
By decision of Minister André Mendonça, Roberta Luchsinger had to surrender her passports and will be monitored by an electronic ankle monitor. The General Prosecutor’s Office (PGR) ruled against the precautionary measure requested by the PF.
