THE Legislative Assembly of São Paulo (Alesp) approved in the early hours of last Wednesday 17th a bill which determines that companies respect the human rights as a criterion for “social skills” participate in state government tenders. The text proposed by the MP Emidio de Souza (PT) modifies the wording of Law 6.544/1989, which deals with state tenders and contracts. “The adoption of the concept of social adequacy, as one of the qualifying conditions for a company that intends to contract with the public administration of the State, represents the acceptance of an ethical principle that will not only guide the establishment of relationships between the public sector and the private sector, but that will guide private companies on the path to recognizing the relevance of their actions in the dissemination of values,” the parliamentarian wrote.
The text received favorable opinions from the rapporteurs of the Finance, Constitution and Justice and Infrastructure committees. Ricardo França (Podemos), rapporteur of the Infrastructure Committee, estimated that “this change could encourage companies to act in a more responsible and committed way towards society, and also promotes integrity and transparency in relations between companies and public administration”.
