Convicted over 2013 fire, former nightclub member saw progression authorized by Court
The convict Elissandro Spohr, known as Kiko, left the Canoas State Penitentiary, in the Porto Alegre metropolitan area, and began serving his sentence in open regime, using an electronic ankle bracelet, in the Kiss case. The progression was authorized by the Court last Monday (15), and departure took place the next day.
Spohr was sentenced to 12 years in prison for the January 2013 fire at the Kiss nightclub in Santa Maria, which killed 242 people. According to the defense, electronic surveillance equipment has already been installed and he is monitored outside the prison system.
The confirmation was made by lawyer Bruna Andrino de Lima, who is part of the team responsible for defending the accused. As he progressed, Spohr began to comply with the conditions imposed by the open regime, including monitoring using an ankle bracelet.
Others convicted during this procedure remain subject to different regimes. Mauro Hoffmann, also a former member of the nightclub, is serving a semi-open sentence after having his sentence reduced from 19 years and six months to 12 years. He is represented by the same law firm.
Group members Gurizada Fandangueira, Marcelo de Jesus dos Santos and Luciano Bonilha Leão, are serving sentences in São Vicente do Sul state prison. Both had their sentences reduced from 18 to 11 years and benefited from the progression to the semi-open regime, which allows them to go out during the day for professional activities and return to the prison unit at night.
Currently, Marcelo works professionally in the municipality itself. Luciano, in turn, is awaiting judicial authorization to work outside and continues to perform internal functions in the prison.
With Elissandro Spohr’s move to the open regime, defenses of other convicts are expected to evaluate similar requests in the coming months, depending on compliance with legal requirements.
What Spohr’s defense says
On the afternoon of last Monday (15th), Elissandro Spohr’s defense issued a statement on the decision, on Tuesday he left the prison and is now under electronic surveillance thanks to an ankle bracelet. View the defense statement:
All legal conditions having been met, after the defensive request, the transition to the open regime and conditional release were granted in favor of Elissandro Spohr.
Among the conditions set, Elissandro will have to continue working, appear periodically in court to justify his activities and, for the moment, will use an electronic ankle bracelet.
Finally, the Defense reiterates that Elissandro continues to strictly respect the sentence imposed, as he has done until now.
